The subject of this agreement is the sale and delivery of the product sold by the SELLER to the BUYER, the specifications and sales price of which are stated below, and the determination of the rights and obligations of the parties in accordance with the Law on Consumer Protection No. 4077, the Regulation on Distance Contracts, and other relevant legal provisions.
2.1 The BUYER declares that they have read, understood, and are aware of their rights and obligations under this agreement.
2.2 The SELLER and BUYER agree that there is no imbalance between the obligations set forth in this agreement and that mutual obligations are appropriate to the nature of the service. They also confirm that they do not lack experience regarding the subject matter of this agreement.
2.3 The BUYER declares that they have fully assessed that the transactions within this agreement are in their own interest and that they accept all terms freely, willingly, and without any pressure or hardship.
2.4 The SELLER and BUYER agree that the provisions of this agreement do not contain any unfair terms and that there is no imbalance of interests between the parties.
2.5 This agreement, its annexes, and all transactions carried out via www.bodrumflowersshop.com comply with Article 6 of the Regulation on Procedures and Principles Regarding Campaign Sales.
2.6 The provisions of this agreement do not contain any unfair terms in accordance with the Regulation on Unfair Terms in Consumer Contracts and are prepared in compliance with consumer protection legislation, in accordance with the principles of good faith and honesty.
2.7 This agreement has been prepared in accordance with the Turkish Code of Obligations No. 6098. The BUYER acknowledges that they have reviewed the binding nature and content control under Article 21 of the Code. None of the provisions of this agreement contain surprising or unusual terms and are written clearly and unambiguously.

6.1 The BUYER declares that they have read and acknowledged all preliminary information regarding the main characteristics of the product, sales price, payment method, and delivery conditions electronically.
6.2 The product shall be delivered within the legal period not exceeding 30 days, depending on the distance to the buyer’s location. This period may be extended by a maximum of 10 days, provided that the consumer is informed in writing.
6.3 If the product is to be delivered to a third party, the SELLER cannot be held responsible if the recipient refuses delivery.
6.4 The SELLER is responsible for delivering the product complete, undamaged, and in accordance with the order specifications. The SELLER may, with justified reason, supply an equivalent product of equal quality and price.
6.5 Delivery is subject to confirmation of this agreement and payment of the order amount. If payment is not made or is canceled, the SELLER shall be released from the obligation to deliver the product.
6.6 In case of force majeure or extraordinary circumstances such as adverse weather conditions or transportation disruptions, the SELLER shall inform the BUYER. The BUYER may cancel the order, request replacement of the product with an equivalent one, or postpone delivery until the obstacle is removed. If the order is canceled, the payment shall be refunded within 10 days.
6.7 In case the BUYER fails to fulfill payment obligations, the SELLER may initiate legal proceedings including debt collection, enforcement actions, and other legal remedies.
According to Article 7/4(c) of the Regulation on Distance Contracts, the right of withdrawal does not apply to goods prepared in line with the consumer’s special requests or personal needs.
Additionally, there is no right of withdrawal for goods that are perishable or may deteriorate quickly or expire soon.
All complaints and objections arising from this agreement shall be submitted to the Consumer Arbitration Committees or Consumer Courts in the place of residence of the BUYER or SELLER, depending on the monetary limits determined annually by the Ministry of Customs and Trade.
